Terms and Conditons
1. **Scope of Agreement**
- These terms and conditions ("Terms") govern the sale of handmade items ("Products") by [Evermore Flower] ("Seller") to customers ("Buyers") who purchase Products through the Seller's online platform or website ("Platform").
2. **Orders and Payments**
- By placing an order through the Platform, Buyers agree to purchase the selected Products at the specified price.
- Payment for Products must be made in full at the time of purchase. The Seller accepts payment through paypal credit or credit card via paypal.
- The Seller reserves the right to cancel any order or refuse service at its discretion.
3. **Shipping and Delivery**
- The Seller will make reasonable efforts to ship the Products to the address provided by the Buyer within the specified timeframe.
- Shipping costs, including any applicable taxes, customs duties, or import fees, are the responsibility of the Buyer.
- The Seller is not responsible for delays or damages incurred during transit.
- International Buyers are responsible for complying with customs regulations and import restrictions in their country. The Seller is not liable for any customs-related issues.
4. **Returns and Refunds**
- The Seller do not accept returns or exchanges for any Products purchased through the Platform.
- In the event that a Product is received defective or damaged, Buyers must notify the Seller within 3 days of delivery. Refer to defective or damage policy (under Return policy) for more.
- The Seller may, at its discretion, offer a replacement or refund for defective or damaged items upon verification.
5. **Variations in Handmade Goods**
- Buyers acknowledge that handmade goods may exhibit variations in color, texture, or size due to the nature of the crafting process.
- Each item is unique and may differ slightly from the product photos provided on the Platform.
- Product photos provided on the Platform are for illustrative purposes only and may not fully capture the exact appearance or characteristics of the handmade goods.
- By purchasing handmade goods through the Platform, Buyers agree to accept and embrace the inherent variations in craftsmanship that contribute to the uniqueness of each item.
- While the Seller strives to maintain consistency in quality and craftsmanship, exact replication of handmade goods as depicted in product photos cannot be guaranteed.
6. **Intellectual Property**
- All intellectual property rights, including copyrights and trademarks, associated with the Products and Platform belong to the Seller.
- Buyers may not reproduce, distribute, or modify the Products without the Seller's express consent.
7. **Limitation of Liability**
- In no event shall the Seller be liable for any indirect, incidental, special, or consequential damages arising out of the purchase or use of the Products.
- The Seller's total liability under these Terms is limited to the purchase price of the Products.
8. **Governing Law and Dispute Resolution**
- These Terms shall be governed by and construed in accordance with the laws of Malaysia.
- Any dispute arising out of or relating to these Terms shall be resolved through negotiation in good faith. If the dispute cannot be resolved amicably, it shall be submitted to the exclusive jurisdiction of the courts in Malaysia.
9. **Changes to Terms**
- The Seller reserves the right to update or modify these Terms at any time without prior notice. Changes will be effective upon posting on the Platform.

By purchasing Products through the Platform, Buyers acknowledge that they have read, understood, and agree to be bound by these Terms and any additional policies or guidelines referenced herein.
Return and Exchange Policy
1. **Return and Exchange**
- The Seller does not accept returns or exchanges for any Products purchased through the Platform.
- All sales are final.
2. **Defective or Damaged Items**
- In the event that a Product is received defective or damaged, Buyers must notify the Seller within 3 days of delivery.
- The Seller may, at its discretion, offer a replacement or refund for defective or damaged items upon verification.

2a) **Photographic Evidence:** The buyer should provide clear photographs or videos showing the damage or defect of the product.
2b) **Proof of Purchase:** The buyer should provide evidence of their purchase, such as an order confirmation email or invoice.
2c) **Shipping Packaging:** If the damage occurred during shipping, the buyer may need to provide photographs of the packaging, including any visible signs of mishandling or damage.
3. **Missing Parcels**
3a) **Reporting a Missing Parcel**
- If a Buyer believes their parcel is missing, they must notify the Seller within 5 days of the expected delivery date as provided by the shipping carrier.
- The Buyer must provide the order number and any relevant information to assist in locating the missing parcel.
3b) **Investigation Process**
- Upon receiving a report of a missing parcel, the Seller will initiate an investigation with the shipping carrier to locate the package.
- The investigation may involve contacting the carrier, reviewing tracking information, and checking delivery records.
- The Seller will keep the Buyer informed throughout the investigation process and provide updates on the status of the missing parcel.
3c) **Resolution Options**
- If the missing parcel is confirmed lost or undelivered by the shipping carrier, the Seller will offer the Buyer the following resolution options:
- Reshipment of the same item, subject to availability.
- Replacement with a similar item of equal value, as agreed upon by both parties.
- Refund of the purchase price, including any shipping fees, if the item cannot be replaced.
3d) **Limitations**
- The Seller is not responsible for parcels that are confirmed delivered by the shipping carrier, even if the Buyer claims non-receipt.
- If the Buyer provided an incorrect or incomplete shipping address, resulting in missing parcel, the Seller is not liable for the missing parcel.
- The Seller is not responsible for delays caused by factors beyond their control, such as customs processing or natural disasters.
4. **Exceptions**
- This return and exchange policy does not affect any statutory rights that may apply under relevant consumer protection laws.
5. **Governing Law**
- This Return and Exchange Policy shall be governed by and construed in accordance with the laws of Malaysia.

By purchasing Products through the Platform, Buyers acknowledge that they have read, understood, and agree to be bound by this Return and Exchange Policy, which states that the Seller does not accept any returns or exchanges.
